TERMS & CONDITIONS

Photography Contract Terms and Conditions:

1. Definitions: a. "Photographer" refers to the professional photographer or photography company providing the services. b. "Client" refers to the individual or entity hiring the photographer for the photography session. c. "Photography session" refers to the agreed-upon date, time, and location for capturing photographs.

2. Right to a Credit: a. The photographer has the right to be credited for any published photographs. The client agrees to provide a credit line in the form of "Photography by [Photographer's Name]" whenever the photographs are used in print or online media. b. If the client wishes to use the photographs without providing a credit line, an additional fee may be negotiated and agreed upon in writing.

 

3. Exclusivity: a. The client understands that the photographer may be photographing other clients or events during the same period as the agreed-upon session. The client will have the photographer's undivided attention during the specified session time but acknowledges that the photographer may not be exclusive to their event.

 

4. Image Use Rights and Copyright: a. The client understands and agrees that the photographer retains the copyright and ownership of all photographs taken during the session, including any post-processing or editing. b. The client will be granted a limited, non-exclusive, and non-transferable license to use the photographs for personal purposes. This includes displaying, printing, and sharing the images with family and friends. c. The client may not sell or commercialize the photographs without the explicit written permission of the photographer. The photographer reserves the right to use the photographs for promotional purposes, including online portfolios, social media, contests, and exhibitions, unless otherwise agreed upon in writing.  All persons photographed will need to sign and return a model release agreement prior to the shoot taking place.

 

5. Booking in Writing: a. The booking confirmation and any subsequent changes or updates must be made in writing, either electronically or in hard copy using a mutually agreed-upon form or contract. b. Both the photographer and the client must retain a copy of the signed contract for their records.

 

6. Deposit: a. A non-refundable deposit of 25% of the total agreed-upon fee is required to secure the booking. The deposit is due upon signing the contract and is necessary to reserve the photographer's services for the specified date and time. b. The remaining balance of the agreed-upon fee must be paid in full before or on the day of the photography session, unless otherwise stated and agreed upon in writing.

 

7. Charges and Timing: a. The fees charged by the photographer and the timing of the photography session will be outlined in the contract or booking confirmation. b. The client agrees to be punctual and ensure that the necessary time is allocated for the session. Any delays caused by the client may result in a reduction of the available session time, unless otherwise agreed upon in writing.

 

8. Payment Terms and Payment: a. A non-refundable deposit of 25% of the total agreed-upon fee is required to secure the booking, as stated in the deposit clause. b. The remaining balance of the agreed-upon fee must be paid in full before or on the day of the photography session, unless otherwise stated and agreed upon in writing. c. Payment methods accepted by the photographer will be specified in the contract.

 

9. Travel Expenses: a. For any location beyond an hour's distance traveled from the photographer's base location, additional travel expenses will be charged. These expenses may include transportation costs (e.g., fuel, airfare, train tickets), accommodation, meals, and other related costs. b. The specific travel expenses and rates will be agreed upon and documented in writing before the photography session takes place. The client will be responsible for reimbursing the photographer for these expenses.

 

10. Cancellation Policy: a. If the client cancels the photography session with less than 24 hours' notice, the full amount of the agreed-upon fee will be charged. b. If the client cancels the photography session with at least 24 hours but less than 48 hours' notice, 50% of the agreed-upon fee will be charged. c. If the client cancels the photography session with more than 48 hours' notice, no cancellation fee will be charged.

 

11. Cancellation by the Photographer: a. In the unlikely event that the photographer is unable to fulfill the agreed-upon services due to unforeseen circumstances, the photographer reserves the right to cancel the booking. In such cases, the photographer will make reasonable efforts to provide a suitable replacement photographer or to reschedule the session. b. If rescheduling or finding a replacement photographer is not possible, the photographer's liability will be limited to a refund of any fees paid by the client.

 

12. Delivery of Images: a. The final edited images will be delivered to the client via a secure, password-encrypted online platform or other mutually agreed-upon method. b. The photographer will provide the client with instructions on accessing and downloading the images. The client is responsible for securely storing and backing up the images after downloading.

 

13. Archiving of Images: a. The photographer will store and archive all final images for a period of one year from the date of delivery. b. If the client requires access to archived photographs after the one-year period or requests additional storage time, an administrative fee may be charged, as agreed upon in writing. c. The photographer is not liable for any loss or theft of images stored in the archive beyond the one-year storage period. Within the one-year period, the photographer's liability is limited to the cost of the original fee paid by the client.

 

14. Additional Terms: a. The photographer will make every reasonable effort to capture high-quality photographs, but cannot guarantee specific outcomes or results. b. In the event of unforeseen circumstances or force majeure that prevents the photographer from fulfilling the agreed-upon services, the photographer will make reasonable efforts to reschedule the session. If rescheduling is not possible, the photographer's liability will be limited to a refund of any fees paid by the client.

 

15. Applicable Law: a. This agreement shall be governed by the laws of England and Wales. Any disputes arising from or related to this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

16. Variation: a. No variation of the terms and conditions set out herein shall be effective unless agreed in writing by both parties.

By signing/agreeing to this contract, the client acknowledges that they have read, understood, and agreed to all the terms and conditions outlined above.
